Keeping tax to a minimum

You can pass as much money as you want to a spouse or civil partner and do so without paying a penny in tax.

However…

There’s a tax free way to give gifts of up to £3,000 every year to your kids while you’re still alive.

But, without a Will, your spouse will probably receive £250,000 worth of your assets and 50% of whatever remains. The other 50% is usually split evenly between your kids or other members of your family, but is heavily taxed.

When Rik Mayall died, he didn’t have a will and with assets totalling £1.2 million, hundreds of thousands of pounds were hit by a 40% tax.

Even if you’re not as well off as Rik Mayall once was, you still need to consider the rising value of your assets and, in particular, your property.

  • If you have neighbours who have dutifully and lovingly looked after you for many years, they won’t get anything, because your entire estate will be seized by the government. 

These are just three examples of how the government don’t consider your personal relationships once you’ve gone.

The rules are black and white, therefore even if you think your situation is relatively typical, you still need a Will.
